What Is Civil Litigation?

Civil litigation is a legal dispute between two or more parties that seek money damages or a right recovering rather than criminal sanctions.

In most cases, Civil Litigation involves disputes between individuals, businesses, or non-profit organizations. Furthermore, civil litigation can be related to the public law issues.

A lawyer who specializes in civil litigation is known as a "litigator" or "trial lawyer." Trial lawyers represent parties in trials, hearings, arbitrations and mediations. The role of the civil litigation professional is challenging and diverse. Since civil litigation is an adversarial process, it is a responsibility of litigation attorneys and paralegals to assume an oppositional position and embrace conflict and controversy.

Litigation Process

Civil litigation includes the following stages: investigation, pleadings, discovery, pre-trial, trial, settlement and appeal. Nevertheless, not all the lawsuits pass through each litigation stage meansioned above. Most lawsuits are settled prior to trial. Also, there are cases that reach a trial verdict without appealing.

 

A civil litigation lawsuit starts right after the filing of the written complaint by a plaintiff. The defendant will then respond and deliver a written "answer" to the complaint in order to make any kind of plea.

 

After the answer is filed, the parties engage in the "discovery" process. At this point the parties will learn about all the facts involved in the case in order to prepare the trial. The discovery process includes witness questioning and answering, the exchange of documents, as well as written questions, known as interrogations.
